Terms of Service

These Terms of Service ("Terms") govern your access to and use of olbrain — the candidate portal hosted at hiring.olbrain.com and operated by Olbrain Technologies Private Limited ("olbrain", "we", "us"). By signing in, submitting an application, or otherwise using olbrain, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You may use olbrain only if you:

  • Are at least 18 years old and legally able to enter into a binding contract;
  • Are legally permitted to seek employment in the jurisdiction where you intend to work; and
  • Are not barred from receiving services under the laws of India or any other applicable jurisdiction.

2. Your account

You sign in to olbrain using a Google account. You are responsible for:

  • The accuracy of the information you provide.
  • Maintaining the security of the Google account you use to access olbrain.
  • Activity that occurs under your account, except where caused by our negligence or wrongful act.

Notify us at legal@olbrain.com promptly if you suspect unauthorized access.

3. Application content

When you submit application materials, messages, interview responses, or other content (collectively, "Application Content") to olbrain, you represent that:

  • The content is accurate, current, and not misleading;
  • You own it, or you have the necessary rights and permissions to share it with us;
  • It does not infringe any third party's intellectual property, privacy, or other rights; and
  • It does not contain anything unlawful, defamatory, harassing, obscene, or malicious.

You retain ownership of your Application Content. You grant olbrain a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and review your Application Content solely to operate olbrain, evaluate your application, communicate with you, and meet related legal and audit requirements. This licence ends when we delete your Application Content under the retention rules in our Privacy Policy.

4. AI-assisted interviewing

olbrain may use AI agents — currently Cognia — to conduct, score, or summarize interviews. You acknowledge that:

  • AI-assisted interviews are recorded and transcribed. See our Privacy Policy for details on how this data is handled.
  • A human reviewer in our recruiting team reviews material outcomes before any hiring decision. AI signals inform — but do not solely determine — our decisions.
  • You may request a human-only interview as an alternative by emailing legal@olbrain.com with the role you have applied to.
  • You must not attempt to manipulate, deceive, or jailbreak the AI interviewer — for example, by impersonating others, using undisclosed assistance, or injecting instructions intended to alter its behaviour.

5. Acceptable use

You agree not to:

  • Submit false, fabricated, or materially misleading information, including ghost-written or AI-generated content presented as your own where doing so misrepresents your abilities;
  • Access olbrain using another person's credentials, or share your credentials with anyone else;
  • Probe, scan, or test the vulnerability of any system or network related to olbrain, except under a written authorization from us;
  • Interfere with or disrupt olbrain, its servers, or networks — for example, by scraping at scale, sending automated traffic, or attempting denial-of-service;
  • Reverse engineer, decompile, or attempt to derive the source code or underlying models of olbrain, except as expressly permitted by law;
  • Use olbrain to violate any applicable law, regulation, or third-party right.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

6. No employment offer

Use of olbrain, completion of an interview, or any communication through the portal does not constitute an offer of employment, a guarantee of an interview, or any promise of a particular outcome. Any employment relationship arises only from a separate written offer letter signed by both parties.

7. Intellectual property

olbrain, its design, code, content, and trademarks (including "olbrain", "Cognia", and related marks) are owned by olbrain or its licensors and are protected by intellectual-property laws. Nothing in these Terms transfers ownership of any of these materials to you.

8. Third-party services

olbrain uses third-party services — including Google sign-in, Firebase Authentication, Google Cloud, Vercel hosting, and AI model providers — to deliver its functionality. Your use of those services through olbrain is also governed by the relevant third-party terms, which we do not control.

9. Disclaimers

olbrain is provided "as is" and "as available". To the maximum extent permitted by law, olbrain disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that olbrain will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, olbrain, its affiliates, and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of olbrain, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to these Terms or your use of olbrain will not exceed Indian Rupees one thousand (INR 1,000). This limit applies even if a remedy fails of its essential purpose.

11. Indemnification

You agree to indemnify and hold harmless olbrain and its personnel from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your Application Content; or (c) your violation of any law or third-party right.

12. Termination

You may stop using olbrain at any time by signing out and, if you wish, by requesting account deletion at legal@olbrain.com. We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the service. Sections 3–11 and 13–14 survive termination.

13. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. You and olbrain agree to submit to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India, for any dispute arising out of or related to these Terms or your use of olbrain, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via the candidate portal or by email to the address associated with your account, with at least 14 days' notice before the change takes effect. Continued use of olbrain after the effective date constitutes acceptance of the updated Terms.
